The federal government does not have the constitutional authority (read “legal authority”) to order employers to provide a perk for their employees. However, those in the federal government, empowered by the unchallenged ability to order employers to pay certain wages (minimum wage), now feel empowered to order employers to provide certain fringe benefits (medical insurance). Salaries and fringe benefits should be left to negotiations between employer and employee.
